Agreement to these Terms

These Terms of Service apply to the GHUBKIT Discord application, the website at ghubkit.com, and the GHUBKIT web control panel. The service is operated by Assiduous Solutions S.R.L. (Moldova company IDNO 1024600049921). In these Terms, "GHUBKIT," "we," "us," and "our" refer to that operator.

By installing GHUBKIT, signing in to the control panel, using a command, interacting with a component, or otherwise using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

Eligibility and authority

You must be allowed to use Discord under Discord's rules and under the laws that apply to you. If you use GHUBKIT for a company, community, team, or other organization, you confirm that you have authority to act for that organization and to accept these Terms on its behalf.

You may install or configure GHUBKIT only in servers where you have the required Discord permissions and authorization from the server owner or responsible administrators.

What GHUBKIT provides

GHUBKIT provides tools for Discord server operations. Features may include temporary voice rooms, gaming sessions, tickets, applications, leaderboards, feedback, Team Spaces, moderation utilities, server configuration, and related administrative workflows.

Some features are optional and become active only after a server administrator configures them. Feature availability may depend on Discord permissions, Discord API access, server settings, account access, plan limits, product status, and technical capacity.

Your responsibilities

You are responsible for:

• Keeping your Discord account secure and protecting access to administrator accounts.
• Reviewing the permissions granted to GHUBKIT and removing permissions that are not needed.
• Configuring channels, roles, limits, automation, and moderation actions carefully.
• Making sure your server rules and use of GHUBKIT comply with applicable laws and Discord policies.
• Informing members when local law or your own policies require notice about automated processing.
• Reviewing important automated actions and correcting settings that produce unintended results.

You are responsible for activity performed through your account and for actions taken by people to whom you grant server management or control-panel access.

Acceptable use

You must not use GHUBKIT to:

• Break the law, violate Discord policies, or help another person do so.
• Harass, threaten, exploit, impersonate, defraud, or harm another person.
• Send spam, unwanted advertising, deceptive messages, or abusive automated notifications.
• Access accounts, servers, channels, data, or systems without authorization.
• Upload malicious code, interfere with service operation, bypass limits, or abuse recovery systems.
• Scrape, copy, resell, reverse engineer, or commercially exploit the service except where law permits it.
• Infringe intellectual property, privacy, publicity, contractual, or other rights.
• Misrepresent GHUBKIT as being operated, endorsed, or guaranteed by Discord.

We may apply technical limits, block abusive activity, or require additional verification when needed to protect users, Discord, GHUBKIT, or the stability of the service.

Content, configuration, and permissions

You keep any rights you have in text, configuration, application answers, feedback, team information, or other content submitted through GHUBKIT. You grant us a limited permission to process, store, format, transmit, and display that content only as reasonably needed to operate, secure, support, and improve the service.

You confirm that you have the rights and permissions needed to submit content and instruct GHUBKIT to publish or process it. Do not submit confidential, regulated, or sensitive information unless the feature is intended for it and you are authorized to do so.

Server administrators may configure GHUBKIT to publish content into Discord channels or direct messages. Visibility inside Discord is controlled by Discord permissions and server configuration.

Discord and third-party services

GHUBKIT is an independent third-party Discord application. Discord is operated separately and is not responsible for GHUBKIT. Your use of Discord remains subject to Discord's Terms of Service and other Discord policies.

The service may depend on Discord, hosting providers, databases, authentication services, and other infrastructure. Changes, restrictions, outages, or enforcement actions by those providers may affect GHUBKIT availability or functionality.

Availability, beta status, and service changes

GHUBKIT is currently offered as a closed beta. Features may be incomplete, changed, limited, unavailable, or removed. We may adjust commands, workflows, limits, storage, permissions, or supported integrations to improve security, reliability, performance, compliance, or product direction.

We do not promise uninterrupted operation or permanent availability of any feature. Maintenance, deployment changes, provider outages, security incidents, abuse prevention, or technical failures may temporarily interrupt the service.

Plans, limits, and payments

The closed beta currently provides free access. No payment-card information is collected through GHUBKIT at this time. We may introduce paid plans, trials, quotas, or premium features later.

Before charging for a paid service, we will present the relevant price, billing period, included features, cancellation rules, refund conditions, taxes, and any additional payment terms that apply. Plan limits may be enforced by server, account, feature type, or another clearly described unit.

Suspension and termination

You may stop using GHUBKIT at any time. A server owner or administrator may remove the app from a Discord server. You may also sign out of the web control panel and request deletion as described in the Privacy Policy.

We may restrict, suspend, or terminate access when we reasonably believe there is abuse, a security risk, a violation of these Terms, a violation of Discord policies, a legal requirement, or a threat to users, infrastructure, or service stability. Where practical, we may provide notice or an opportunity to correct the issue.

Disclaimers

To the extent permitted by applicable law, GHUBKIT is provided "as is" and "as available." We do not make guarantees about uninterrupted availability, error-free operation, compatibility with every server configuration, preservation of all data, or suitability for a particular purpose.

GHUBKIT assists with server workflows but does not replace human review. You should verify important settings, permissions, moderation decisions, schedules, role changes, and destructive actions.

Limitation of liability

To the extent permitted by applicable law, GHUBKIT and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, lost revenue, lost data, lost goodwill, service interruption, or unauthorized server changes arising from use of or inability to use the service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Mandatory consumer rights that apply to you remain unaffected.

Changes to these Terms

We may update these Terms when the service, legal requirements, security practices, providers, or business model changes. The updated page will show a new effective date and last-updated date.

For material changes, we may also provide notice through the website, control panel, Discord app, or another reasonable channel. Continued use after the effective date means you accept the updated Terms where applicable law permits that form of acceptance.

General terms

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision does not waive the right to enforce it later. You may not transfer your rights or obligations under these Terms without our permission, except where applicable law gives you that right.

These Terms and the Privacy Policy form the agreement between you and GHUBKIT concerning the service, unless separate written terms expressly apply to a specific paid plan, promotion, or enterprise use.
